The appellant was convicted of failing to provide the necessaries of life to his elderly father, who suffered from dementia and lived in squalid, unsafe conditions in the appellant's home. The appellant appealed the conviction, arguing the trial judge failed to adequately explain why the father was under his 'charge' and that the evidence did not support such a finding. The appellant also appealed his sentence of six months' imprisonment. The Court of Appeal dismissed the conviction appeal, finding the trial judge's reasons sufficient and supported by evidence of the appellant's control over his father's living conditions and personal care. The majority also dismissed the sentence appeal, holding that the six-month term was fit given the gravity of the offence and the need for denunciation and deterrence. A dissenting judge would have allowed the sentence appeal and imposed a conditional sentence.
