Court of Appeal for Ontario
Teitelbaum v. Dyson
Date: 2001-09-04
Plaintiff/appellant, acting in person;
(File No. C35572)
[1] By the Court: Ms. Teitelbaum appeals the order of Caputo, J. who refused to set aside the settlement she had made with the defendants. Caputo, J., held that though Ms. Teitelbaum may have felt victimized, she nonetheless pursued the respondent and insisted on settling, fully understanding the legal effect of her actions. Caputo, J., also held that the $20,000 settlement was not [illegible], in the light of the earlier $72,000 payment to Ms. Teitelbaum to settle her appeal on the judgment of Rosenberg, J. In our view the findings of Caputo, J., are supported by the evidence, and as an appellate court we have no bases to interfere with them. Therefore the appeal is dismissed with costs if demanded.
Appeal dismissed.
