Her Majesty the Queen in Right of Canada requests under Rule 2.1.01(6) of the Rules of Civil Procedure for a determination that Mr. Weinstein’s claim is frivolous or vexatious or otherwise an abuse of process. It is not necessary to resort to the procedure under Rule 2.1.01(3) of the Rules of Civil Procedure. In my view, this is not the clearest of cases where the test has been met. Resort to this rule is not meant to be an easily accessible alternative to a pleadings motion or a motion for summary judgment.
