The appellant trucking company sought an extension of time to appeal the 45-day impoundment of its truck, which occurred after its driver was found driving with a suspended licence.
The appeal was filed after the impoundment period had expired.
The Registrar brought a counter-motion to dismiss the appeal, arguing the Tribunal lacked jurisdiction to hear an appeal commenced outside the impoundment period.
The Tribunal held that it does have jurisdiction to hear such an appeal, finding that the statutory language does not restrict appeals to the impoundment period.
However, applying the factors for an extension of time under s. 7 of the Licence Appeal Tribunal Act, the Tribunal declined to grant the extension due to the length of delay, lack of bona fide intention to appeal within the time limit, and weak merits of the due diligence defence.
Both motions were dismissed.
