The applicants appealed a decision by Tarion Warranty Corporation disallowing several claims regarding alleged defects in their new home, including issues with support columns, basement height, insulation, air conditioner placement, duct debris, and a bathroom faucet.
The Licence Appeal Tribunal reviewed the claims under the Ontario New Home Warranties Plan Act.
The Tribunal dismissed all claims except for the bathroom faucet, finding that the other items either met the Building Code, were contractual issues outside its jurisdiction, or did not constitute a breach of warranty.
