REASONS FOR DECISION
1The parties agree that the appellant was entitled to 101 more days of pre-sentence custody than was applied at sentencing. This amounts to 152 days of custody after credit is granted at the rate of 1.5 to 1.
2Accordingly, leave to appeal sentence is granted and the appeal is allowed such that the sentence is reduced by 152 days.
3After this reduction the appellant has 18 days left to serve. As there is no public interest in having the appellant re-surrender into custody, we stay the balance of the custodial portion of the sentence.
