COSTS ENDORSEMENT
1This court released its reasons for decision in this matter on May 27, 2026, T.C.O. Agromart Ltd. v. Sutton Farms (Nacona) Ltd., 2026 ONCA 371, and ordered costs of the appeal in favour of the appellant. Given the appellant’s success on the appeal, the parties were also advised that the appellant was prima facie entitled to costs of the trial as well.
2The parties were urged to agree on the quantum of those costs. They have now advised the court of the agreed-upon amount.
3Accordingly, an order shall go requiring the respondents to pay the appellant trial costs in the agreed-upon sum of $250,000, all inclusive.
