COURT OF APPEAL FOR ONTARIO
Huscroft, Dawe and Wilson JJ.A.
BETWEEN
Christopher Lynch
Appellant (Moving Party)
and
Ross Wilson Holdings Ltd.
Respondent (Responding Party)
Christopher Lynch, acting in person
Spencer Toole, for the responding party
Heard and rendered orally: June 3, 2026
On review of the order of Justice Bradley Miller of the Court of Appeal for Ontario, dated April 9, 2026.
REASONS FOR DECISION
1This is a motion for a panel review of the motion judge’s decision to deny the moving party’s request to stay a decision of the Divisional Court that removed a stay of an eviction order. The moving party confirms that he has since been evicted from his apartment.
2A reviewing panel can intervene only if the motion judge erred in principle or reached an unreasonable result. The moving party has not established that the motion judge erred in any way. In any event, the motion seeking a stay is now moot.
3Accordingly, the motion is dismissed.
4The responding party is entitled to costs of $3,250 all inclusive, payable forthwith.
