ENDORSEMENT RE COSTS

[1] The costs claimed by the respondent are well beyond the range for a one-day appeal in this court. In addition, the respondent’s motion to quash the appeal was dismissed. In our view, taking into account the complexity and importance of the issues, the amount at issue, and the result achieved, the respondent should be awarded costs fixed at $50,000 inclusive of disbursements and GST.
