The applicant argued the motion was premature because the expert report was only a draft.

The Tribunal granted the motion, finding the documents were relevant to the assessment of damages and that foundational documents relied upon by an expert must be disclosed to enable the opposing party to assess its position.

The Ontario Federation of Agriculture applied for the renewal of its accreditation as a farm organization under the Farm Registration and Farm Organizations Funding Act, 1993.

The Tribunal held a hearing to determine whether the organization met the prescribed criteria set out in Ontario Regulation 783/20.

The Tribunal found that the organization largely satisfied the criteria but required further evidence regarding the public availability of its audited financial statements and the inclusion of supporter numbers in those statements.

The Tribunal granted a provisional accreditation for 60 days to allow the organization to provide the required evidence.

The Christian Farmers Federation of Ontario applied to the Agriculture, Food and Rural Affairs Appeal Tribunal for the renewal of its accreditation as a farm organization under the Farm Registration and Farm Organizations Funding Act, 1993.

The Tribunal reviewed the evidence provided by the applicant against the prescribed criteria set out in Ontario Regulation 783/20.

The National Farmers Union - Ontario (NFU-O) applied to the Agriculture, Food and Rural Affairs Appeal Tribunal for the renewal of its accreditation as a farm organization under the Farm Registration and Farm Organizations Funding Act, 1993.

The Canadian Sheep Federation and three provincial sheep organizations brought a motion for participant status in an appeal challenging the Ontario Sheep Marketing Agency's license fee and exemption policy.

The moving parties argued the policy acts as an inter-provincial trade barrier affecting out-of-province producers.

The Tribunal granted participant status to the Canadian Sheep Federation, finding it could provide useful contextual and historical evidence without causing injustice to the respondent.

The motions by the three provincial organizations were dismissed, as they are members of the Canadian Sheep Federation and will have a voice through that organization.

The Ontario Sheep Marketing Agency brought a preliminary motion to dismiss an appeal by two non-resident sheep producers regarding the collection of license fees.

The Agency argued the producers lacked a sufficient interest in the subject matter of the appeal.

The Tribunal dismissed the motion, finding that the producers were aggrieved persons who were required to pay fees and thus had a sufficient interest to be entitled to a hearing on the merits.

The appellant, representing licensed chicken processors, appealed a reconsideration decision of the respondent local board regarding the collection of data for the Cost of Production Formula used to set minimum live chicken prices.

The appellant requested that the respondent collect specific data on third-party labour costs, feed cost discounts, and government payments in its Operating Costs Survey, which the respondent refused.

The Tribunal held a bifurcated hearing to determine its jurisdiction.

The Tribunal found that it lacked jurisdiction to hear the appeal because the respondent's decision was discretionary and not mandated by legislation, and because the pricing of chicken is determined by a negotiating agency, which falls under the exclusive jurisdiction of the Ontario Farm Products Marketing Commission.

The appeal was dismissed.

The applicant applied to the Agriculture, Food and Rural Affairs Appeal Tribunal for a religious exemption from farm registration and payment under the Farm Registration and Farm Organizations Funding Act, 1993.

The applicant stated he did not have religious convictions.

The Tribunal dismissed the application on its own motion without a hearing, finding that a lack of religious convictions is not a religious conviction or belief, and therefore no remedy was available under the Act.

The moving parties brought a motion for an extension of time to file appeals under sections 48 and 54 of the Drainage Act regarding a municipal drain.

The Tribunal granted the extension for the section 48 appeals, finding a bona fide intention to appeal, a reasonable excuse for the short delay due to illness, and triable issues.

However, the Tribunal dismissed the motion regarding the section 54 appeals because no such appeals had actually been filed to date, leaving the length of delay undetermined.

The applicant purchased a farm implement from the respondent and later cancelled the order.

The respondent agreed to refund the $28,890 purchase price but failed to do so.

The applicant filed a complaint under the Farm Implements Act.

On the merits of the section 54 appeal, the Tribunal found that the majority of the engineer's assessments were fair and reasonable.

However, the Tribunal reduced the benefit assessment for Lot 5 regarding an engineered berm, finding no significant soil erosion to justify the specific benefit, and reduced the assessment for Branch C, finding the allowances should not have factored into the assessment calculations.

The appeal was allowed in part.

The appellants appealed the Engineer's Report regarding the McGee Drain under the Drainage Act.

One appellant reached an agreement with the municipality to revise the report and withdrew his appeal.

The remaining appellants argued their assessment should be reduced because the drainage issues were caused by another landowner.

The Tribunal dismissed the appeals, finding the assessments in the revised Engineer's Report to be fair and reasonable, and adopted the revised report.

The appellants challenged an administrative decision finding that they illegally transported milk between two separately licensed dairy facilities operating on the same property and imposing $10,000 in penalties.

The Tribunal held a de novo hearing and applied the civil standard of proof, requiring clear, cogent and convincing evidence because of the serious licensing consequences.

It found the respondent's case was entirely circumstantial and did not establish, on a balance of probabilities, that milk had been moved contrary to the regulation.

The tribunal accepted the appellants' explanation for unusual production patterns and found the trailer-mounted tank evidence inconsistent with clandestine milk transfer.

The decision and penalties were set aside, and any deducted penalties were ordered credited back.

The applicant municipality applied to the Agriculture, Food and Rural Affairs Appeal Tribunal under section 76(1) of the Drainage Act for permission to procure an engineer's report to vary the 1924 Schedule of Assessment for a municipal drain.

The Tribunal found that changes in land use, severances, and the fact that only one-third of the watershed area was assessed justified a variation.

As no assessed persons objected, the Tribunal granted the requested permission.

The Association of Ontario Chicken Processors appealed a reconsideration decision of the Ontario Broiler Hatching Egg & Chick Commission regarding a new Cost of Production formula.

The appellant sought six amendments to the formula, including changes to the prime rate calculation, exclusion of depreciation from working capital, adjustments to farm labour benefit and wage rates, use of a real rate of return, and addition of a risk premium.

After hearing extensive expert testimony from all parties, the Tribunal found the expert evidence presented by the respondent and third party to be more reliable and acceptable on all six issues.

The appeal was dismissed.

The appellants appealed the assessments in an Engineer's Report prepared under section 78 of the Drainage Act for the improvement of the Dell Drain Outlet.

The proposed work involved extending the outlet to address severe gully erosion on downstream properties.

The Tribunal found that the erosion was primarily caused by water flowing from upstream lands and that the drain currently lacked a sufficient outlet.

The Tribunal amended the Schedule of Assessment, determining that the costs should be apportioned as 26% Benefit to the adjacent downstream properties and 74% Outlet Liability to the upstream lands and roads, and assessed a Special Benefit to lands subsequently connected to the drain.

The appellants appealed their municipal drain assessments under section 54 of the Drainage Act, seeking reductions in their outlet liability and benefit assessments.

They argued that a lower runoff factor should have been applied to their property, which is a provincially significant wetland, and that they received no benefit from the drainage works.

The Tribunal dismissed the outlet liability appeals because the appellants failed to provide expert evidence to contradict the municipality's engineer.

However, the Tribunal allowed the appeal regarding the $1,000 benefit assessment, reducing it to zero, as the property would not increase in value or be more easily maintained as a result of the works.

The appellants appealed their Outlet Liability assessment under the Drainage Act for the Komoka Drainage Works.

They argued the drainage works should be funded entirely by the municipality's Stormwater Management levy or that their assessment should be reduced due to an inappropriate equivalent factor applied to their agricultural land.

The Tribunal dismissed the appeal, finding that the appellants' properties were not in the Settlement area and did not pay into the Stormwater levy.

The Tribunal also found the engineer's use of a 1.0 factor for agricultural lands was fair and reasonable, and that the assessment was calculated correctly using the modified Todgham method.
