The accused was charged with five offences under section 163.1 of the Criminal Code relating to child pornography: accessing child pornography between August 1 and December 2, 2014; making child pornography available on August 6 and August 11, 2014; and possessing child pornography on those same dates.
Following a trial held on March 8 and 9, 2016, the court found the accused guilty on all counts.
The Crown established that child pornography files were located on the accused's computer through both online investigation and forensic analysis following execution of a search warrant.
The court rejected the defence arguments that the accused was not the computer user and that prompt deletion of files negated possession.
