The appellants appealed a ruling by the Judges that declared a race at Flamboro Downs a 'No Contest' under Rule 22.33 of the Rules of Standardbred Racing.
The Ontario Racing Commission allowed the appeal, finding that under Rule 22.32, the race could be determined a 'No Contest' only for those horses prevented from having a fair chance due to exceptional circumstances.
The Commission ordered the race to be charted, declared the top finishers eligible for the Gold Final and consolation race, and directed the distribution of the purse monies accordingly.
