The arbitrator agreed, finding that the Insurance Act only confers jurisdiction for automobile contracts formed in Ontario or for out-of-province contracts where the insured automobile was operated in Ontario.
Since neither scenario applied, the arbitration was dismissed for lack of jurisdiction.
