The applicant sought compensation from the Criminal Injuries Compensation Board for injuries sustained when he was shot at a farm where an illegal marijuana grow operation was taking place.
The Board found that while the applicant was a victim of a crime of violence and suffered injuries as a result, he and his associates refused to cooperate with the police investigation, leading to the withdrawal of serious criminal charges against the alleged perpetrators.
Pursuant to section 17(2) of the Compensation for Victims of Crime Act, the Board exercised its discretion to deny the application entirely due to this lack of cooperation.
