The respondent filed a Notice of Hearing under s. 74 of the Firearms Act seeking a review of the nullification of his firearm registration certificate after his Colt Rifle was reclassified as a prohibited firearm by an Order in Council.
The Attorney General brought an application to summarily dismiss the hearing for lack of jurisdiction.
The Ontario Court of Justice granted the dismissal, finding that the nullification resulted from a change in the law by the government, not a decision by the Registrar of Firearms, and therefore the court had no jurisdiction to review the matter or grant the requested injunctive relief.
