Following a natural gas explosion that caused severe injuries and deaths, the trial judge and Court of Appeal found the appellant gas company 25% liable and the respondent municipalities 75% liable.
The appellant appealed to the Supreme Court of Canada, claiming full indemnity from the respondents.
The Supreme Court dismissed the appeal, holding that a party cannot be indemnified for its own negligence in the absence of a clear contractual right, and the appellant's own negligence barred recovery beyond the 75% allowed by The Negligence Act.
