The applicant appealed the City of Toronto's refusal of a zoning by-law amendment application to permit a 10-storey mixed-use building.

At the first Case Management Conference, the Tribunal granted party status to a local residents' association and an abutting neighbour, and participant status to one individual.

The Tribunal scheduled an eight-day hearing and directed the parties to finalize a Draft Procedural Order and Issues List.

The Ontario Land Tribunal issued an amending decision to correct technical errors in a previous decision regarding an appeal for official plan and zoning by-law amendments in the Township of King.

The amendment added an omitted appearance for a party and corrected the date for witness statements in the attached Procedural Order.

The applicant appealed the failure of the Township of King and Region of York to make decisions on applications for an Official Plan Amendment, Zoning By-law Amendment, and Site Plan Approval to permit 48 stacked townhomes.

At this second Case Management Conference, the Ontario Land Tribunal finalized the Procedural Order, including the issues list and timeline for the exchange of witness lists, and scheduled a 15-day video hearing.

The City of Toronto sought leave to appeal a decision of the Ontario Municipal Board (OMB) which found it had jurisdiction to determine whether site plan control applied to a proposed change of use for the respondent's property.

The Chief Building Official had refused a building permit on the basis that site plan control applied.

The Divisional Court granted leave to appeal, finding reason to doubt the correctness of the OMB's decision on a true question of jurisdiction, and noting the issue was of sufficient general importance.
