The respondent brought an action in the Supreme Court of Alberta against the Northern Pipeline Agency for damages for wrongful dismissal.
The appellant sought to strike out the action, arguing it was an action against the Crown and therefore within the exclusive jurisdiction of the Federal Court.
The Supreme Court of Canada held that the Agency, having entered into the employment contract in its own name pursuant to its statutory powers, could be sued in its own right.
Consequently, the action was not against the Crown, and the provincial superior court retained jurisdiction.
