The City of Windsor applied for approval of a local improvement by-law to authorize the construction of a sanitary sewer and private drain connections on Baseline Road.
Several property owners objected, raising concerns about the cost of the work, recent replacements of existing septic systems, and the mandatory decommissioning of septic systems.
The City presented expert engineering evidence demonstrating the environmental necessity of the sewer to reduce contamination from failing septic systems.
The City also offered several financial and procedural concessions to ease the burden on property owners.
The Tribunal found the environmental evidence unchallenged and the by-law appropriate and justified, approving the by-law and ordering the City to implement the proposed concessions.
