The appellants appealed the City of Ottawa Committee of Adjustment's refusal of consent and minor variance applications to sever a property into two lots for the construction of two detached triplexes.
The City did not appear at the hearing.
Relying on the uncontroverted expert planning evidence of the appellants, the Tribunal found that the applications were consistent with the Provincial Policy Statement, conformed to the Official Plan, and met the criteria under the Planning Act.
The Tribunal allowed the appeals, granted provisional consent subject to conditions, and authorized the minor variances.
