The municipality's expert land use planner testified that the proposed lot creation in a prime agricultural area and within a shoreline erosion hazard was not consistent with the Provincial Policy Statement 2024 and did not conform to the Chatham-Kent Official Plan or Zoning By-law.
The applicant provided no expert planning evidence to contradict this.
The Ontario Land Tribunal accepted the municipality's evidence, finding the application failed to demonstrate consistency with provincial policies or conformity with local planning documents, and dismissed the appeal.
