The Ontario Land Tribunal issued a procedural order on consent following a case management conference regarding appeals of a proposed zoning by-law amendment and plan of subdivision in the Town of Mono.

The order schedules a 17-day virtual merits hearing to commence on September 21, 2026, and sets out the procedural dates and issues list for the hearing.

The applicant appealed the municipality's refusal of a consent application to create four new residential lots and four opposing beach lots on agricultural lands bisected by Rose Beach Line.

The municipality's expert land use planner testified that the proposed lot creation in a prime agricultural area and within a shoreline erosion hazard was not consistent with the Provincial Policy Statement 2024 and did not conform to the Chatham-Kent Official Plan or Zoning By-law.

The applicant provided no expert planning evidence to contradict this.

The Ontario Land Tribunal accepted the municipality's evidence, finding the application failed to demonstrate consistency with provincial policies or conformity with local planning documents, and dismissed the appeal.

The Ontario Land Tribunal held a first Case Management Conference regarding appeals by Line 2 Developments Inc. against the Town of Mono for failing to make decisions on zoning by-law amendment and draft plan of subdivision applications.

The applications propose a 349-unit residential development with communal water and sewage systems.

During the CMC, the Tribunal granted participant status to one individual and scheduled a motion brought by the Town to dismiss the appeal.

The Tribunal also directed the parties to submit a draft Procedural Order and Issues List by July 11, 2025, to facilitate the scheduling of a future hearing on the merits.

The Ontario Land Tribunal held a fourth Case Management Conference regarding appeals by Huntingwood Trails (Collingwood) Ltd. against the Town of Collingwood's refusal of applications for an official plan amendment, zoning by-law amendment, and draft plan of subdivision to permit a 69-unit residential development.

Following Tribunal-led mediation, the parties submitted a revised draft Procedural Order and Issues List.

The Tribunal approved the updated Procedural Order and scheduled a 30-day merits hearing to commence in January 2026.

The applicant appealed the City of Brampton's refusal of its Official Plan Amendment and Zoning By-law Amendment applications to permit the development of two multi-storey residential apartment buildings.

The Tribunal previously allowed the appeals in part and in principle, withholding its final order until certain conditions were met.

The parties confirmed the conditions were satisfied, and the Tribunal issued its final order approving the amendments.

The applicant appealed the City's failure to make a decision on a zoning by-law amendment application to facilitate a 34-storey mixed-use building.

Following an interim decision that approved the amendment in principle, the Tribunal issued a final order allowing the appeal in part and amending the zoning by-law, as the City confirmed that all conditions had been fulfilled and the final form of the by-law was satisfactory.

The Ontario Land Tribunal held a Case Management Conference regarding appeals by ABC Eglinton LP due to the City of Toronto's failure to make a decision on Official Plan and Zoning By-law Amendment applications for a 19-storey mixed-use development.

The Tribunal granted party status to an adjacent property owner, approved several participant requests, and scheduled a second Case Management Conference and a 10-day hearing on the merits.

The appellant appealed the Township's refusal of Official Plan Amendment, Zoning By-law Amendment, and Consent applications to permit the severance of a rural property into three residential lots.

The central issue was whether the proposed lots could be adequately serviced by private water cisterns, given the lack of municipal water and inadequate groundwater for wells.

The Tribunal preferred the evidence of the appellant's experts, finding that cisterns are a viable and common water source in the area and that the proposed intensification is compatible with the surrounding rural character.

The appeals were allowed and the applications approved subject to conditions.

The appellant appealed the City of Stratford Committee of Adjustment's decision to deny a minor variance application seeking to increase the maximum permitted height for a new detached dwelling from 10.0 metres to 11.39 metres.

The variance was requested to accommodate an elevator shaft hidden within the roofline.

The Ontario Land Tribunal found, based on uncontroverted expert planning evidence supported by the City, that the requested variance met the four tests under section 45(1) of the Planning Act.

The appeal was allowed and the variance was authorized subject to conditions.

The Ontario Land Tribunal held a Case Management Conference regarding appeals for a proposed 20-lot residential subdivision due to the municipality's failure to make a decision.

The appeal was allowed and the variance authorized subject to the requested condition.

The applicant appealed the municipality's failure to make a decision on applications for an Official Plan Amendment, Zoning By-law Amendment, and Plan of Subdivision for a mixed-use development.

At the first Case Management Conference, the parties advised the Tribunal that a settlement in principle had been reached.

The Tribunal scheduled a one-day settlement hearing for July 4, 2022, and directed the submission of planning affidavit evidence.
