Minor variance for increased driveway width authorized subject to grading and drainage conditions.
The appellant appealed a Committee of Adjustment decision denying a minor variance to increase the maximum permitted width of hard surfaces for a driveway and walkway from 4.5 metres to 5.6 metres.
The City supported the application subject to a condition requiring grading and drainage details.
The Tribunal found that the variance met the four tests under section 45(1) of the Planning Act, noting that the additional hard surface was minor, desirable for the area, and consistent with neighbourhood character.
The appeal was allowed and the variance authorized subject to the requested condition.
