The appellants appealed the Town of Erin's Development Charge By-law 24-35 under section 14 of the Development Charges Act, 1997.
The parties reached a settlement resolving issues related to fire services, parks and recreation, roads, public works, water, and the growth forecast, which reduced the development charges.
Based on the uncontroverted affidavit evidence of a land economist, the Tribunal found the settlement fair, reasonable, and in accordance with the Act.
The Tribunal allowed the appeals in part, amended the by-law's schedule of development charges, and ordered the Town to issue refunds accordingly.
