THESE MATTERS, having come before the Tribunal for a hearing in writing to consider a settlement proffered by the parties with respect to appeals by Mattamy (Erin) Limited, 2779181 Ontario Inc., EC (Erin) GP Inc., Hillsburgh Heights Inc., National Properties Inc., and Beachcroft Investments Inc. of the Town of Erin’s Development Charge By-law 24-35 pursuant to s. 14 of the Development Charges Act, 1997, S.O. 1997, c. 27;
AND THE TRIBUNAL having received the affidavit of Byron Tam, land economist, sworn on June 1, 2026, and the affidavit sworn June 8, 2026, attesting to the mediation that ultimately led to the settlement agreement between the Town of Erin and Mattamy (Erin) Limited, 2779181 Ontario Inc., EC (Erin) GP Inc., Hillsburgh Heights Inc., and Beachcroft Investments Inc. confirmed in Minutes of Settlement dated February 25, 2026, wherein the Parties resolved issues related to fire services, parks and recreation, roads, public works, water and the growth forecast that reduces the development charges imposed by By-law 24-35 in accordance with the adjustments in the Minutes of Settlement set out in revised Schedule B of By-law 24-35 attached as Attachment 1 to this Order;
AND THE TRIBUNAL having received the affidavit of Byron Tam sworn June 8, 2026 attesting to the separate settlement between the Town of Erin and National Properties Inc. set out in Minutes of Settlement not in front of the Tribunal that resolved the issues between the Parties also as set out in revised Schedule B of By-law 24-35 attached as Attachment 1 to this Order;
AND THE TRIBUNAL having considered and accepted the uncontroverted affidavit evidence of Byron Tam that the proffered settlement that modifies the capital program and growth forecast set out in revised Schedule B of By-law 24-35 attached as Attachment 1 represents an appropriate recovery of the charge to facilitate growth within the Town of Erin, is in accordance with the provisions of the Development Charges Act, 1997, and is fair and reasonable;
NOW THEREFORE
THE TRIBUNAL ORDERS THAT
The appeals by Mattamy (Erin) Limited, 2779181 Ontario Inc., EC (Erin) GP Inc., National Properties Inc., Hillsburgh Heights Inc., and Beachcroft Investments Inc. of the adoption of Development Charge By-law 24-35 by the Town of Erin are allowed, in part.
Pursuant to s. 16(3) of the Development Charges Act, 1997, Schedule B of Development Charge By-law 24-35 is amended as set out in Attachment 1 to this Order.
The Town of Erin shall issue refunds with respect to the revised Schedule B of Development Charge By-law 24-35 at Attachment 1 in accordance with s. 18 of the Development Charges Act, 1997.
The Tribunal may be spoken to in the event of issues in the implementation of this Order.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”).
