The appellants, extraprovincial motor carriers, challenged the validity of an extra-provincial licence issued by the Alberta Motor Transport Board, arguing it could not regulate transportation out of the province.
The appellants also claimed damages for the seizure of their trucks by the Board.
The Supreme Court of Canada held that the federal Motor Vehicle Transport Act authorized the provincial board to regulate extraprovincial undertakings operating into, through, and out of the province.
The Court also held that the federal Act did not displace provincial enforcement powers, including the power to seize equipment.
The appeal was dismissed.
