The City of Toronto brought a motion for costs against a neighbourhood association for its failure to pay $500 in mandatory witness attendance fees after summoning four City staff to a hearing.
Despite multiple reminders and a prior Tribunal order compelling payment, the association refused to pay and unsuccessfully sought a review of the order.
The Tribunal found the association's conduct to be clearly unreasonable and an abuse of process, noting that the obligation to pay attendance money is a basic procedural requirement.
The Tribunal awarded the City $5,000 in costs on a partial indemnity basis.
