The appellant, who has multiple grouped criminal appeals pending, moved for leave to add a new ground of appeal alleging ineffective assistance of counsel in three of those appeals.
The Court of Appeal for Ontario denied the motion, finding no reasonable explanation for the appellant's delay in raising the new claim.
Additionally, the court noted that allowing the new ground would cause substantial further delay to the resolution of the already long-delayed appeals.
The court struck the notices of appeal raising the new claim and ordered the grouped appeals to be scheduled for hearing.
