On a stated case, the Supreme Court of Canada held that while the Board has broad remedial powers to secure compliance with the duty to bargain, it cannot impose the substantive terms of a collective agreement.
The Court also found the Board lacked statutory authority to award compensation or costs for a breach of the duty to bargain.
