The self-represented plaintiff brought a motion appealing a case management order issued by Prothonotary Tabib under Rule 51 of the Federal Courts Rules.

The order set scheduling steps for a pending motion by the defendants to have the plaintiff declared a vexatious litigant.

The plaintiff alleged the prothonotary was complicit in treason, conspiracy, and torture by permitting the proceeding to go ahead.

The Federal Court held the plaintiff failed to demonstrate that the prothonotary's scheduling order was incorrect in law or based on a palpable and overriding error.

The allegations of bias and complicity were found to be completely baseless.

The appeal was dismissed.

The plaintiff, self-represented, filed a motion for an interlocutory injunction against several defendants, alleging torture and interference in relation to a family law dispute and provincial health enforcement.

The Federal Court dismissed the motion, finding it lacked jurisdiction as the claims involved matters within provincial jurisdiction.

The Court also found the plaintiff failed to meet the three-part test for an interlocutory injunction, noting the claims lacked a serious issue to be tried and failed to demonstrate irreparable harm.

Costs were awarded to the defendants.
