The appellant served a notice of appeal in November 1974 but did not inscribe the appeal for hearing until February 1980, well beyond the one-year time limit under rule 59 of the Supreme Court Rules.
The appellant brought an oral motion to extend the time to inscribe the appeal.
The Supreme Court of Canada dismissed the motion and held the appeal to have been abandoned.
