The applicants appealed a decision of the City of Ottawa Committee of Adjustment denying minor variances for reduced parking space lengths for a newly constructed semi-detached dwelling.
The Ontario Land Tribunal allowed the appeal, finding based on uncontroverted expert planning evidence that the variances met the four tests under s. 45(1) of the Planning Act.
The Tribunal authorized the variances, noting they had no adverse physical or visual impact on the streetscape and were supported by City planning staff.
