Alcohol and Gaming Commission of Ontario

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to revoke the liquor delivery licence of the Licensee and ordered an interim suspension.

Evidence established that the Licensee's delivery service repeatedly delivered alcohol to minors without checking identification or obtaining proper signatures, and failed to maintain accurate records as required by the regulations.

The Board found multiple breaches of the Liquor Licence Act and its regulations, concluding that the Licensee's conduct afforded reasonable grounds for belief that he would not carry on business in accordance with the law.

The interim suspension was ordered to remain in effect pending a final decision on penalty.

The Registrar alleged that the named licensee was acting as a front for his brother, who was the true owner and had a serious criminal record, including a recent conviction for possession of stolen property kept at the bar.

Furthermore, both brothers failed to disclose their recent criminal convictions on the renewal application.

The Board found the explanations for the false statements unacceptable and concluded that the licensee would not carry on business with integrity and honesty.

The Board declined to renew the liquor sales licence.

The Board of the Alcohol and Gaming Commission of Ontario held a pre-hearing teleconference regarding a Notice of Proposal to suspend the liquor licence of Alibi Roadhouse Inc. The Board issued a procedural order directing the licensee to disclose its witness list, witness summaries, and any expert reports to the Registrar within specified timeframes prior to the hearing.

AGCO inspectors observed a patron with a glass of beer at the bar at 3:34 AM.

The Board found that the licensee violated the regulations regarding hours of service and removal of signs of service, preferring the clear and consistent evidence of the inspectors over the licensee's witnesses.

However, the Board dismissed the allegations of obstructing the inspection, finding insufficient evidence that the licensee was involved in pouring out the beer or that the delay in unlocking the door was unreasonable.

The Board previously found that the Licensee violated section 29 of the Liquor Licence Act and subsection 45(1) of Ontario Regulation 719/90, and ordered a 10-day suspension of its liquor licence.

The Licensee proposed suspension dates which were acceptable to the Board.

The Board ordered the liquor licence suspended for 10 consecutive days commencing January 4, 2010.
