AND IN THE MATTER OF THE LIQUOR LICENCE OF MARIO’S COMPANY INC., OPERATING AS MARIO’S BROS RESTAURANT, 1890 WESTON ROAD, TORONTO LICENCE NUMBER 24820
O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on November 16, 2009, pursuant to Notice of Proposal (“NOP”) number 17482 dated August 21, 2009, to suspend liquor licence number 24820 issued to Mario’s Company Inc., (the “Licensee”), operating as MARIO’S BROS RESTAURANT, 1890 Weston Road, Toronto, Ontario, M9N 1W1;
AND WHEREAS the Registrar’s Representative, Phillip Morris, and the Licensee’s Representative, Khaled Amin, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing January 6, 2010;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative, pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will re-send disclosure materials provided with the NOP and complete any further disclosure, also pursuant to Rule 10.2, ten (10) days before the hearing date.
