The Ontario Land Tribunal held a Case Management Conference regarding appeals by the applicants against the City of Toronto's failure to make decisions on applications for an Official Plan Amendment, Zoning By-law Amendment, and Draft Plan of Subdivision to permit three mixed-use residential towers.

The Tribunal issued a Procedural Order to govern the proceedings leading up to a 9-day hearing scheduled to commence on June 1, 2026.

The Ontario Land Tribunal issued a Procedural Order on consent to govern the proceedings for appeals concerning a proposed mixed-use residential development at 1799 St. Clair Avenue West in Toronto.

The appeals relate to the City's failure to make decisions on applications for an Official Plan Amendment, Zoning By-law Amendment, Draft Plan of Subdivision, and Site Plan.

The hearing is scheduled for 9 days commencing March 23, 2026.

The applicant appealed the Committee of Adjustment's refusal of a minor variance application to permit the construction of an 8-unit multiple dwelling with reduced parking, reduced rear yard setback, and increased lot coverage.

The Ontario Land Tribunal allowed the appeal and authorized the variances, accepting uncontested expert planning evidence that the proposal represents appropriate residential intensification, is transit-supportive, and meets the four tests under the Planning Act.

The applicant appealed the City of Welland Committee of Adjustment's refusal of a minor variance application to permit the construction of a three-storey, 15-unit multiple dwelling with zero on-site parking.

The Tribunal accepted the uncontested expert planning evidence that the proposal represents appropriate residential intensification, makes efficient use of municipal infrastructure, and satisfies the four tests under section 45(1) of the Planning Act.

The appeal was allowed and the variances were authorized.

The applicant appealed the city council's refusal of a zoning by-law amendment to permit multiple dwelling units within an existing building.

Prior to the hearing, the parties reached a settlement to permit five dwelling units and four surface parking spaces.

Based on uncontested expert planning evidence, the Tribunal found the revised zoning by-law amendment consistent with provincial policies, in conformity with the official plan, and representative of good planning.

The appeal was allowed in part to implement the settlement.
