The Tribunal found that the applicant did not provide a reasonable explanation for the delay under s. 34, noting a lack of documentary evidence to support claims that her counsel attempted to contact the respondent earlier.
The Tribunal held that the respondent was prejudiced by the delay, as the applicant had moved out of the country, preventing medical assessments.
The application was dismissed as statute-barred.
