The appellant appealed an engineer's report under the Drainage Act that recommended removing his farm access bridge over the Jarvis Drain and providing an allowance for loss of access.
The appellant argued the bridge was still required for his farming operations.
The Tribunal found that the appellant was entitled to continued access and ordered the report amended to require the rehabilitation of his bridge to the same standard as two other bridges on the drain.
The Tribunal declined to order the bridges be widened to 20 feet or replaced with concrete structures, finding the proposed 16-foot width and materials acceptable.
