The grievors alleged that the employer denied them fair access to hours of work by offering only 8, 10, and 12-hour shifts, preventing them from achieving 40 hours per week and thereby denying them CSD credit.
The employer argued that under Article 18.01(b) of the collective agreement, CSD credit is calculated based on full-time weeks worked, meaning 40 hours.
The Grievance Settlement Board dismissed the grievances, finding that the collective agreement does not guarantee 40 hours of work per week for unclassified employees and clearly requires full 40-hour work weeks for CSD calculation.
