The appellant pled guilty to assault with a weapon against her intimate partner and was denied a conditional discharge at sentencing.

The Superior Court of Justice dismissed the appeal, finding that the sentencing judge properly considered the gravity of the offence, which involved striking the partner with a metal barrel and repeatedly punching him, and did not make the offender's sex an inappropriate sentencing factor.
