The appellant, a university student accused of an academic offence, sued his university, professors, and the Chartered Professional Accountants of Ontario (CPAO) in Small Claims Court.
The motion judge struck the claim against the CPAO, finding it had statutory immunity under the Chartered Professional Accountants of Ontario Act, 2017.
On appeal to the Divisional Court, the appellant argued the motion judge erred in law, demonstrated bias, and made palpable and overriding errors.
The Divisional Court dismissed the appeal, concluding the CPAO acted within its legislative mandate in recognizing prerequisite courses and was protected by statutory immunity, and found no evidence of bias or procedural unfairness.
