The applicants, minor citizens of Chad, sought judicial review of a Refugee Appeal Division decision denying their refugee protection claims.
The applicants had alleged a risk of targeting by child traffickers in Chad, independent of their mother's refugee claim which had been granted.
The Federal Court found the RAD's decision unreasonable because it failed to consider objective documentary evidence regarding this risk.
The application for judicial review was allowed and the matter was remitted for reconsideration.
