Two adult children applied for child support from their biological parents.
The children had been in the care of their maternal grandparents since 1996 pursuant to a court order.
The father claimed financial hardship and inability to pay, while the mother was receiving Ontario Works and later had those benefits terminated.
The court found the father's evidence regarding his financial circumstances to be evasive and misleading, and imputed income of $100,000 to him based on his actual income in prior years and unexplained deposits and expenditures.
The court ordered retroactive child support from January 1, 2009, and ongoing support based on the imputed income.
The mother was ordered to pay a modest amount based on her actual income of approximately $14,800 per year.
The father was also ordered to contribute $25,000 toward one child's university expenses and one-third of the other child's post-secondary education costs.
