The Appellant, a commissioned salesperson, sought to deduct $86,231.25 paid to a corporation he controlled for the preparation of a business plan.
The Tax Court of Canada dismissed the appeal, finding that the Appellant was not required by his contract of employment to incur the expense, nor was the amount expended in the 2014 taxation year.
The Court also noted that the amount paid exceeded the fair market value of the services rendered.
