Human rights applications alleging workplace discrimination, harassment, and reprisal dismissed for lack of credible evidence.
The applicant, a Black woman from Jamaica with severe asthma, alleged that she was subjected to discrimination and harassment in the workplace and that her subsequent termination was a reprisal for filing a human rights complaint.
The Human Rights Tribunal of Ontario found insufficient credible evidence to support the allegations of a management-initiated rumour or discriminatory treatment.
The Tribunal concluded that the applicant's suspensions and ultimate termination were the result of documented workplace misconduct and service failures, and that the respondents were unaware of the human rights complaint at the time of termination.
The applications were dismissed.
