The applicants, parents of the deceased, applied for a certificate of appointment as estate trustees without a will for an estate valued at $76,000.
They also sought an order dispensing with the administration bond requirement.
The court granted the certificate but declined to make the order dispensing with the bond, noting that under section 36(3) of the Estates Act, small estates under $150,000 are statutorily exempt from the bond requirement, making such an order unnecessary.
