The applicant, mother of the deceased, applied for a certificate appointing her as estate trustee without a will for an estate valued at $112,450.02.
She also requested an order dispensing with the requirement to post an administration bond.
The court found that the estate qualified as a 'small estate' under the Estates Act, and therefore, pursuant to section 36(3), no bond was required by law.
The court declined to make an unnecessary order dispensing with the bond and directed that the certificate issue.
