The applicant, a citizen of Turkey and permanent resident of Canada since 1991, sought judicial review of an Immigration Appeal Division (IAD) decision dismissing his appeal of a deportation order based on serious criminality.
The applicant had multiple criminal convictions since 2002, often involving alcohol, with his most recent in 2018.
The IAD found insufficient humanitarian and compassionate considerations to warrant a stay of removal, noting the seriousness of his offences, his failure to take responsibility, low prospects for rehabilitation, and embryonic establishment in Canada despite nearly 30 years of residence.
The Federal Court held the IAD's decision was reasonable, finding its assessments of the applicant's testimony and the documentary evidence were justified.
The Court also rejected the applicant's claim of bias, concluding that an informed person would not find a reasonable apprehension of bias in the IAD's reasons when read holistically.
The application for judicial review was dismissed.
