The applicants challenged the Peters First Nation Band Council's second rejection of their band membership applications.
The Council denied membership because the applicants were adults and lacked maternal consent, despite the band's Membership Code containing a "one parent" rule.
The Federal Court found the Council acted unlawfully, unfairly, and in bad faith by imposing arbitrary prerequisites not authorized by the Code.
Holding that the Council had no expanded discretion to ignore the Code's express rules, the Court allowed the application and ordered the Council to grant full band memberships to the applicants forthwith.
