1I granted a motion for default judgment in this matter on January 5, 2026. I noted in my endorsement that "[t]he plaintiff sought no costs, and none are ordered."
2By letter dated January 13, 2026, counsel for the plaintiff advised that the failure to seek costs was inadvertent. They now seek costs. The Bill of Costs is not well-prepared. It fails to give a total amount sought for time, or disbursements. Having reviewed it, the plaintiff appears to seek approximately $6,000 on a partial indemnity scale, including HST, as well as disbursements of $832.10 plus HST of $93.35.
3I fix costs in the amount of $5,000 inclusive of disbursements and costs.
