ENDORSEMENT
[1] This matter was referred to me on July 22, 2026 requesting approval of a proposed settlement as against the remaining defendant, Roc’ N Doc’s Inc. It appears to have been forwarded to the Court sometime ago and misplaced, likely given the prior judgments approved as against other defendants.
[2] The most recent judgment was rendered by me January 10, 2025. The evidence submitted at this time indicated the proposed settlement was achieved in late 2025.
[3] Having reviewed the material, I am prepared to and approve the proposed settlement.
[4] I am satisfied the proposed amount is in the best interest of the person under disability given the issues as to liability and damages. I also accept the evidence from plaintiff’s counsel that the proposed contingent fee, at 33.3 percent of the net settlement amount would have been higher if charged on an hourly rate basis. This litigation involved multiple defending taverns, amendments to pleadings, discoveries, mediation, Pierringer agreements and preparing to attend Trial Scheduling Court.
[5] I have also made minor alterations to the draft judgment to which the Minutes of Settlement refers in an attempt to clarify this appears to be resolution of the claim as against the remaining defendant and that the settlement funds, being paid to the Litigation Guardian (and with end of the litigation) having Power of Attorney for the person under disability, remains obligated to use the funds for the sole benefit of the person under disability and be prepared to pass accounts as may be required by the Public Guardian and Trustee.
